The Buckeye Institute Calls on SCOTUS to Overturn Illinois’ Unconstitutional Gun Law
The Buckeye Institute filed an amicus brief in Herrera v. Raoul, urging the U.S. Supreme Court to hear the case and re-affirm its ruling in New York State Rifle and Pistol Association v. Bruen and overturn Illinois’ ban on the sale, purchase, and possession of certain rifles and standard capacity magazines. “In the wake of Bruen, lawmakers, litigants, and judges are debating how the ruling should apply. But as courts consider the cases brought before them, they are still bound by precedent.”
The Buckeye Institute Joins SCOTUS Brief to Protect Small Businesses
The Buckeye Institute joined the National Federation of Independent Business on its amicus brief in Metal Conversion Technologies v. U.S. Department of Transportation, calling on the U.S. Supreme Court to hear the case and confirm that government agencies must follow the principle of “equitable tolling,” which is a well-established principle in the country’s courts, except in “administrative law” where the longstanding doctrine is often ignored.
The Buckeye Institute Investigates Discriminatory Legal Programs
The Buckeye Institute sent letters to bar associations and law firms that appear to operate or participate in race-based programs in violation of federal law. The Buckeye Institute also sent public records requests to Ohio’s public law schools requesting information on race-based programs operated by the schools. “While the sentiments of these programs may be laudable, they violate federal law and are unconstitutional.”
The Buckeye Institute: Ohio’s Job Market Sends Mixed Signals
The Buckeye Institute commented on the newly released jobs report from the Ohio Department of Job and Family Services. “In January, Ohio’s unemployment rate increased from 3.6 percent to 3.7 percent—in line with the national average for January—while the labor force participation rate remained flat at 61.8 percent—trailing the national average of 62.5 percent. While still low, January’s report continues a trend of climbing unemployment that started in July 2023, indicating a weaker job market.”
New Buckeye Institute Economic Modeling Reveals Billions in Economic Growth Possible for Georgia
A new report, Next Steps for Georgia Tax Reform, by The Buckeye Institute, found that cutting taxes would lead to billions in economic growth and business investment in the Peach State. The Buckeye Institute partnered with Georgia Public Policy Foundation to conduct the research. “Georgia has undertaken several positive tax reforms that have spurred economic growth, but the state must continue to reform its tax policies if it wants to remain competitive.”
The Buckeye Institute Files Class Action Lawsuit Against City of Cleveland
The Buckeye Institute filed a class action lawsuit on behalf of Kate Wos of Strongsville, David Steffes of North Royalton, and all nonresidents of Cleveland who filed a municipal income tax return with the city and received their refund more than 90 days after filing their return. Wos v. Cleveland calls on the court to order the city of Cleveland to follow its own city ordinances and pay Ms. Wos, Mr. Steffes, and anyone else affected the interest Cleveland owes them because the city failed to issue their tax refund within 90 days.
The Buckeye Institute to SCOTUS: Congress Cannot Give Legislative Power to Agencies
The Buckeye Institute filed its second amicus brief in Allstates Refractory Contractors v. Su (previously Allstates Refractory Contractors v. Walsh), calling on the U.S. Supreme Court to hear the case and protect worker and workplace safety by requiring Congress to give clear direction to the Occupational Safety and Health Administration (OSHA) on how to regulate safety in the workplace. The Manhattan Institute joined The Buckeye Institute in filing the brief.
The Buckeye Institute: Courts Shouldn’t Simply Defer to NLRB’s Interpretation of Facts
The Buckeye Institute filed an amicus brief in Starbucks v. McKinney, calling on the U.S. Supreme Court to abide by centuries of jurisprudence and consider the harm to both the employer and employee when deciding whether to grant a preliminary injunction. “When the National Labor Relations Board sues a private company, the government should not get special treatment on its request for a preliminary injunction.”
The Buckeye Institute: Ohio State Agencies Earn Solid B for Cutting Regulations
The Buckeye Institute released a new policy brief, Making the Grade: Ohio’s Success Cutting Regulations, which reviews and grades how Ohio’s state agencies fared in cutting regulations. The Buckeye Institute analysis gives state agencies a B in complying with the Ohio Senate Bill 9, which requires every state agency to cut regulations by 10 percent by June 30, 2023, with the ultimate goal of cutting regulations by 30 percent by June 30, 2025.
The Buckeye Institute: Time to Re-Brew Ohio’s Alcohol Franchise Law
The Buckeye Institute released a new policy brief, Brewing Freedom: Ensuring the Freedom to Contract for Ohio’s Craft Brewers, urging Ohio lawmakers to free Ohio’s small craft brewers from the state’s anti-competitive alcohol franchise law that “disproportionately empowers distributors to the detriment of small craft brewers.” “Ohio’s award-winning craft beer industry is suffering from the anti-competitive effects of the state’s 50-year-old alcohol franchise law.”
