Kudos all around

Congratulations to attorney Bill Todd for a well earned and important victory before the Sixth Circuit Court of Appeals holding that Secretary of State Jennifer Brunner cannot enable vote manipulation by failing to provide public records of voter registrations.

The country has suffered a great deal from what Al Gore and the Florida Supreme Court did in 2000, and the ramifications seem as though they will be playing out for years still. Todd and others fought and won in the district court, had that victory reversed by the appellate court acting in its usual panel form, and then had the original victory reestablished by the full appellate court. That’s good, sophisticated work.

Buckeye’s Maurice Thompson, director of the 1851 Center for Constitutional Law, filed an amicus brief in the case. His reasoning that there is a fundamental right to cast an undiluted vote appears to have been supported by at least some of the judges in the 9-6 ruling.

    Has this gone to the supreme court? I’d be surprised if they’d take it.

    Yes, it has gone to Justice Stevens.

    The votes in dispute are higher than the margin of victory between the President and Senator Kerry in 2004.
