The Buckeye Institute files a motion for the trial court to reconsider its decision to correct its misunderstanding of Professor Uradnik’s First Amendment discrimination claim.

Cert was denied on the preliminary injunction. Uradnik v. IFO is returned to the United States District Court for the District of Minnesota where it will be argued on the merits.

The Buckeye Institute files its petition for certiorari in Uradnik v. IFO with the United States Supreme Court, making it the first significant First Amendment labor-law challenge to reach the Supreme Court since the landmark June 27, 2018 decision in Janus v. AFSCME.

The United States Court of Appeals for the Eighth Circuit grants The Buckeye Institute’s request to affirm the district court decision in light of an earlier decision by the Eighth Circuit. 

September 27, 2018
Judge Paul A. Magnuson denies The Buckeye Institute’s request for preliminary injunction allowing Uradnik v. IFO to be appealed to the United States Court of Appeals for the Eighth Circuit. Buckeye immediately files its notice of appeal and requests that the court affirm the district court decision in light of an earlier decision by the Circuit.
